Legal reference versus offering legal advice or opinion

Reference librarians should provide the best possible reference service to all patrons and yet avoid offering legal advice or opinion.

Reference librarians should:
 • Suggest appropriate legal resources, including books, indexes and electronic resources
 • Instruct patrons in navigating legal resources

Reference librarians should not:

 • Solicit a detailed description of the user’s factual situation
 • Speculate as to the outcome of an issue
 • Tell a patron what procedural steps to follow
 • Appear before adjudicative bodies on behalf of patrons
 • Complete legal forms for patrons

 • Interpret legal materials
