Policy on Relocation and Moving Expenses

The Alexander Campbell King Law Library in accordance with guidance from the University System of Georgia may legally offer to pay relocation expenses for Law Library faculty members from the Law Library's budget if these expenses are documented in written offers of employment (sample letter).

The Law Library will provide the employee the University of Georgia's policy on relocation and moving expenses. The employee should consult a personal tax advisor to evaluate the tax implications of these expense payments and reimbursements.

The Law Library faculty member, the Director of the Law Library, and the Law School Dean must sign a relocation and moving expense agreement.  No reimbursements will be processed until the agreement is signed by all parties. The Law Library will forward the Relocation and Moving Expense documentation package to the Law School budget office for submission to University Accounts Payable. The documentation package consists of:

All expenses must be reasonable and necessary per the USG guidelines, and the employee must be eligible as outlined below:

Eligibility of Employees:

  1. Availability of qualified applicants -- the candiate must be the best qualified candidate available for the position
  2. Full-time employment -- the employee must be assigned a full-time, salaried position and must agree to work on a full-time basis at the library for one-year.
  3. Distance -- The distance between the employee's new work location and former residence must be at least fifty (50) miles greater than the distance between the employee's old work location and former residence.
  4. Time -- The relocation reimbursements/payments are taxable income and must be reported to the IRS unless the employee works at least thirty (39) weeks during the first twelve (12) months after relocating.
  5. Spouses/Partners -- If the employee's partner or spouse is also eligible for reimbursements or payments of relocation costs and moving expenses, these payments will only be made once to move the primary household to a new location. Both employees may not request payment for the same costs.
  6. Relocation of current employees -- If the relocation is in the best interest of the Law Library, then relocation expenses reimbursement and payment is allowable. In such cases, approval of a Senior Vice President is required, and the Law Library should follow the policy outlined at OPB State Policies --Relocation.

Within sixty (60) days of when payment is made or expenses are incurred, the Law Library employee must submit claims for all reimbursement on the Employee Request for Reimbursement of Relocation and Moving Expenses form.

Relocations encumbering more than $5,000 will be arranged by the Law Library in consultation with University Procurement Office, and the employee.

The Law Library is not required to pay relocation expenses and will make such offers only when merited and financially feasible.
